Event Cancellation, Safety and Liability

GNPA Trip and Event Policy and Release of Liability

The GNPA sponsors and promotes photography through field trips, workshops, and events.

Please note that you must be a current member to go on some trips or to register for some events and workshops.

Trips are non-instructional and may require entry fees, etc. be paid to the location where we will be photographing.

All trip costs, including entry fees, transportation, food, and lodging (if needed) are the responsibility of the attendee.

Workshops or events may have fees associated with them. Please read the terms and conditions associated with each and note any additional fees, equipment, etc., that you may be responsible for supplying.

Participants are encouraged to obtain suitable insurance covering their person, their equipment, and trip costs. Equipment insurance is normally available through your homeowner’s insurance policy or as a separate policy. NANPA provides equipment insurance at additional cost to NANPA members covering professionals or amateurs. http://www.nanpa.org/membership/insurance/

By registering for or participating in any event you agree to the following:

Event Cancellation Policy

GNPA will make every attempt to execute each trip, workshop or event (hereafter referred to as “Trip”) as planned and as described on the GNPA website. However, circumstances beyond GNPA’s control may arise that that affect GNPA’s ability to complete a Trip as originally planned. In that case, the trip will be modified as needed and at the complete discretion of GNPA and the trip leader. This may involve changes to hotels, itineraries, transportation, etc. Such changes may involve additional costs or schedule changes for attendees.

If a Trip is cancelled by GNPA for any reason prior to its start date, GNPA will normally refund all deposits and registration fees. GNPA will not make any refunds or provide any compensation for payments by registrants made for any other purpose such as non-refundable hotel deposits, car rental fees, or airline charges. GNPA reserves the right to make changes to the trip including changes to the itinerary and trip leaders at its sole discretion without providing any compensation or refund. If prepaid fees are required and not refundable to GNPA, refunds will be reduced by that amount.

Attendee Cancellation Policy

An attendee unable to attend a Trip for any reason will be responsible for payments as described in the Trip announcement and Cancellation Policy.

GNPA strongly encourages all attendees to purchase trip insurance.

Event Safety

Personal safety is of utmost importance. Nature photography inherently includes risks that all participants must evaluate for themselves. GNPA expects all Trip attendees to take into account their own personal safety and abilities before engaging in any Trip activity.

Please be vigilant and constantly aware of your surroundings and potential hazards that might result in injury to yourself or others. Do not place yourself in danger.

WARRANTY

All events are for our members’ photographic enjoyment and no warranty as to quality, fitness of purpose or other warranty is made other than that specifically stated in writing in respect to any trip, event or workshop.

LIABILITY RELEASE

As a condition of participation with the Georgia Nature Photographers Association [“GNPA”], I agree to release from liability and to hold harmless the GNPA and its officers, agents, employees or assigns for any injury, including illness, accident, emergency and death, and for damage to or loss of personal property, including equipment, film, and memory cards, while participating in any activities affiliated with the GNPA.

PHOTO RELEASE

I do hereby give the GNPA permission to use my photo and its likeness for any and all print and video purposes it deems necessary but not limited to: newsletters, brochures, instructional and promotional videos, and press releases. The GNPA will not be required to reimburse me for use of my photo or its likeness.

SPECIFIC NOTICE REGARDING COVID-19 TO PARTICIPANTS

The novel coronavirus known as COVID-19 is a great concern for us all. In particular, the Center for Disease Control (CDC) states that based on currently available information and clinical expertise, older adults and people of any age who have serious underlying medical conditions might be at higher risk for severe illness from COVID-19. More information about who may be at higher risk may be found at https://www.cdc.gov/coronavirus/2019-ncov/needextra-precautions/people-at-higher-risk.html. If you have any questions about whether you should participate in the event or activity, please contact an appropriate healthcare provider.

While the Georgia Nature Photographers Association Inc. (hereafter referred to as GNPA), a Georgia corporation, has undertaken a number of measures to help mitigate the risk of transmission of COVID-19 and other contagious illnesses, elimination of risk of exposure and infection to COVID-19 is not currently possible. Therefore, we understand if you cannot or do not wish to participate in an event or activity and hope that we can count on your participation in the future should circumstances change. Whether you are able to participate now or in the future, we appreciate you being part of GNPA.

Warning

Under Georgia law, there is no liability for an injury or death of an individual entering these premises if such injury or death results from the inherent risks of contracting COVID-19. You are assuming this risk by entering the premises or participating in any GNPA activity or event.

Should you choose to participate in GNPA activities, you must follow all safety measures implemented by the GNPA with respect to COVID-19. In particular, you maybe required to do the following:

• Report any symptoms of COVID-19 that you may have encountered prior to or during an event of activity, as identified by the CDC athttps://www.cdc.gov/coronavirus/2019-ncov/symptomstesting/symptoms.html

• Maintain social distancing (staying at least 6 feet – about 2 arms’ length – from other people) whenever possible;

• Wash hands with soap and water for at least 20 seconds or use hand sanitizer that contains 60% alcohol including the hand sanitizer as often as possible;

• Wear personal protective equipment such as facecloths or masks that meet CDC guidelines;

• Practice “Safer at Home” behaviors when not at any part of the event or activity during the week including social distancing whenever possible, avoiding unnecessary trips and unnecessary interactions, and wearing masks whenever social distancing is not possible;

• Limit contact and follow safety precautions when traveling or dining preceding or during an event or activity.

Further information about the requirements may be provided preceding or during the event or activity. In connection with member and volunteer activities, including the activities of an underage volunteer (“Minor”) for whom consent is given as such Minor’s legal guardian, members (“Member”) agrees and understand that presence during the GNPA events or activities and any volunteer work or services performed for GNPA (if any), and their officers, directors, agents, or members, as well as any other volunteer (collectively, “Indemnified Parties”) may expose members to unknown and unanticipated risks of harm or injury. In particular, I acknowledge I have received and read the “Specific Notice Regarding COVID-19 to Participants” provided to me.

In consideration of and as a prerequisite to participation, members and legal guardians on behalf of Minors acknowledge that such risks exist, assume all such risks including all risks related to COVID-19, and release and discharge the Indemnified Parties from any and all claims for liability for personal injury or illness (including death) or property damage that such volunteers or Minors may suffer while participating or volunteering, whether or not on the premises of the Facility, including, without limitation, any claim arising out of any condition of the premises used by GNPA for, or conduct of any person during preparation, supervision or conduct of, the event or activity or any practice round or activity related to it. Participants accept full responsibility for the costs of treatment for any illness and/or injury or damages suffered while volunteering in connection therewith. Participants acknowledge having read this release and agree to be bound by the terms set forth herein in consideration for performing volunteer services.
